Can or Will Anyone Help Me? I Need A Lawyer!

To begin with - I have been at this for nearly a year, to no avail! And no one will help me in a legal way, which is pissing me off because ever since the (Dodge 1500) truck accident April 2, 2017 all us involved have been having major problems! My long time friend/caregiver (I have Cerebral Palsy) who was driving had broken is collar bone, was extremely bruised for 4 months, neck brace for six months. He still has problems. Oh! He had coverage but it was the bare minimum as it was all he could until he got paid. My nephew Jeremy who is 6 foot and really slim was a sleep in the back seat. He now has black-outs going down hill. As, for me, I got the worst of it, and Loma Linda and doctors who were responsible for my care as well as a few of the nurses treated me with less care, etc, because i have Cerebral Palsy and used a walke4!

Below is part th account in detail of what happen in its entirety! It was written in letter form for letters! However! the letter, is in parts as it’s quite long.


To whom this, ll Concern:

I was in a personal truck accident last April and ever since I've have been trying to find legal justice and I'm always told can't help or won't help you! Which is, unfair as I am a little person who was discriminated against because i have Cerebral Palsy and so i did not receive the proper care for my broken left (enclosed compound fracture) of my left leg! Which was never immobilized just because I have Cerebral Palsy! Yes, I walked with a walker but not good enough for them to correctly treat me! This is what the doctor and orthopedic at Loma Linda told me and my sister Nicole! —

Last April the truck my I was in a roll over, it rolled 4 times, I broke my left leg, it had an enclosed compound femur fracture! However, it was never immobilized in any way! The ortho said you need surgery but he replied (I refuse to do the surgery) as you have Cerebral Palsy and you don't need to have your leg (its 2 centimeters off) straightened, and you should learn to live with it as it is, and you may not walk again, either! So, just deal. I consider that, Denying Me, Discrimination, just because I have Cerebral Palsy! It's Wrong and against the human rights law, so I thought! Besides. Any Ambulatory (non-disabled) person with a broken leg would've had their leg straightened and immobilized in some way! So, why, is the orthopedic who (Refused/Denied Me) the wanted and needed surgery, Allowed to get away with this!? And so far he is... Why?

After seeing 4 other orthopedics who all agreed that had my (enclosed compound femur fracture) been improperly set/immobilized, the night of the accident, my left leg would have healed straight! And my (left) hip would have never had to compensate for the way I sat, do to the pain! Which means, my hip now is not staying in place so I now have to where a hip brace, forever, etc! Which makes my every day life 10,000 times harder as I now need much more help doing and moving - thus making - My Cerebral Palsy so much more difficult to life with! And The other orthopedics wouldn't help because I needed an ortho specialist which the forth orthopedic, referred me to, at Arrowhead Regional Medical Hospital!

Oh! He wanted to do the surgery but he wanted extra tests which took another 6 weeks with getting the referrals for everything so by the time I saw him, my leg had healed, but not straight! He said, he'd would have to rebreak my leg to straighten it and he didn't want to do that as I've been through enough this year, 2017, I spent it in bed. And I am still in bed!

Below is the full (in parts) account of the accident and my Hospital stay, treatment while at Loma Linda Hospital! It was a horrendous nightmare!

To Whom This Will Concern;

My name is Mary Smith, I am 55 years old and I have Cerebral Palsy which had me in a power chair most of the time. However, my daily life has been drastically changed due do a terrible Truck Accident! Every day is a painful challenge to do nearly everything due to the accident and it's not right, doctors did this to me just because I have Cerebral Palsy! I am asking for help with the medical part as no one in the legal service will even consider trying as this the orthopedic who refused me (needed surgery) due to my having CP, is associated with Loma Linda Hospital! It's considered a very fine line, despite he flat out refused me the much-needed surgery!

The following is an account of the accident and my 3 days stay in Loma Linda Hospital back on April 2nd through the 5th of 2017 and it was horrendous! Due to a Horrific truck accident hours before! Below is an account of the Truck Accident in question.

Steve Silva and (myself, Mary Smith). went to our (our niece) Kylee and Robert's wedding which started at 2 pm - we left between 5/5:30 pm. Steve and I were.in the front and our nephew Jeremy was in the back napping seat belts were worn by everyone but being as I'm 4"11" (the shoulder strap digs into my neck) so I didn't wear the shoulder strap part, if I had - it most likely would have killed me as it rolled! Miracle, my little dog and also my legal Emotional Support Animal was on my lap. Oh! and my chair was tied down in the bed of the truck!

At about 5:55pm - I looked at my watch and noticed the sun was starting to set! I then noticed Steve was fighting with the Steering wheel as i started to ask Steve, what's wrong,, the truck started to roll and it stopped after the fourth roll. I mentioned the steering wheel because it popped now and then! And so, I know, he didn't/wasn't over correcting! He had promised to take it in the following day for a complete checkup!

We brought the 2001 Dodge Ram 1500 quad cab ST, a month ago, from a guy near here, off of Offerup! The guy said, it was in good shape and basic maintenance was constantly maintained! But being as it was a work truck, we wanted it completely checked by a mechanic!

When the truck stopped rolling - I remember being asked some questions which I answered correctly, then asked about Miracle and was told she was fine and with Jeremy who was also fine! I then heard Steve say, he was, okay, too, I heard him say. His left arm was under the truck but he was ok! I knew, I was on Steve's lap but kinda upside down on my neck. I remember my left leg really hurting and was told it was caught under the steering wheel and knew I had hit my head, but I was alert and stayed alert. I remember moving my right arm so the lady could remove my watch for safe keeping, it was/isn't replaceable! I thanked her for her help. And I also Thanked (The Powers that be) for watching over us, especially Miracle.

As, they started to cut the truck with the (jaws of life) my right shoulder blade began to really hurt due to the pressure of the cutting. I then remember, them moving me and me screaming due to the extreme Pain of my left leg! I then remember being on the ground, then a stretcher and being told I was gonna be Air lifted to Loma Linda. I wondered about Steve and where they were taking him but no one said. The same about my nephew Jeremy, no one said, either!

I knew, my sister (Nicole Kendall) was close by as I could hear her yelling at an Officer Burke who was being an Ass and not telling ( or, letting her through to be with Jeremy, her son) her much of what happened to her family! Which she had a right to know, but wouldn't stop being Rude! And cops like him - don't do their job correctly - he never has talked with me or Steve. In my opinion- Officer Burke comes off as (completely) ColdHearted, Asinine,Disrespectful, and Arrogant people person! In goes a report with interviewing every one which tells me that he doesn't give a damn about getting all the facts so the report is, incorrect as well as inaccurate!

Point of interest: I never signed any papers but my discharge papers on the night of the 5th. I NEVER Signed an Arbitration Paper! Nor, was it ever mentioned at any time while I was there!

It was sometime after 7:00 pm when the helicopter landed on Loma Linda's Hospital roof. As I was in the ER, I remember thinking, my head feels like it was gonna explode because my ears really needed to pop and weren't! God, I hated that.... I also remember being asked if I could hear and understand what they were saying such as, do I know where I am or what happened, etc!? I nodded yeah, at one point because my voice was nonexistent, at the time! I remember, them cutting my new blouse up the middle and then off and they cut the pant legs of my velvet pants up both legs. And they removed my pendants and chains, the Dragon pendant was missing when I got my stuff back.

Anyway, while in the ER they took an MRI, X-Rays and I remember as they tried moving me for MRI and x-rays and they started lifting me with nothing under my broken left femur, as it wasn't immobilized, yet! The tech or whoever offered to keep a pillow under it, I said, okay. them sticking me multiple times for an IV as I'm a very hard stick. However, they must have been successful because I had several in my right hand and arm. During all this, I kept wondering how and where Steve and Jeremy were doing as I was very worried about them, considering, I knew nothing.
And It was at least 5 or 6 hours before they took me to my room, I think it was between 1 am and 2 am. The neck brace I was wearing was slightly to big and was starting to bug me, because I was going to have to lay flat... Which I hated, many reasons!

They then transferred me (painfully) to my bed! The nurses then began to clean me up and moving was (extremely painful) as they had to keep rolling me from side to side and yes they tried holding my leg straight as they rolled me but it wasn't working! So, I realized, that I hadn't been to the bathroom in nearly 24 hours, and I knew that the bed pan would (kill) me so I asked to be catheterized so my doctor ordered one!

Thank God! The doctor came in on the second day to check my neck, I had no pain and could move my head so he took the damn thing off! I thanked him and sat up, had a big cold drink!
The meds they had me on were over not helping my pain, much because when I'm in Major Pain my blood pressure goes through the roof! Which it kept doing because I was still in so much F_____pain! The nurses kept asking me if I had high blood pressure, I replied, No! So, they kept giving me more pain meds thinking it would help, but they just ended up overdosing me twice and had to quickly reverse it! I finally got the head nurse to listen to me, on the best way to manage my pain which would bring down my blood pressure! She had to call Nicole to verify my regular meds, even though (my sister) called everyday for updates, etc!, and gave them the list of my regular meds! The list included my Nexium, IB, Robaxin, etc! I told the night head nurse (the second night) to give me my (Robaxin) a muscle relaxer with my pain meds. Because they'll work in unison - together - and its better for my CP! And I was correct, it worked and it brought my blood pressure down to normal within 35 minutes later!

But on the day before I went home, the doctor requested it, removed! So, I had to use the bed, it wasn't too bad, but then this one (PA, Jennifer) wasn't Listening to my advise on how to roll me without causing major pain! She wold tell me that should calm down before I hunt her! Which was so stupid because I could barely move, she was hurting me. She rolled me very hard on to my left side ( which I found easier) then my right! I said, am not hurting you, your hurting me, in between, my screams! She hurt me every time I had to use the bed pan, which was about 5 times a 24 hour period! However, on the day I was to go home I needed to go to the bathroom about an hour before and once again Jennifer had to help, along with another nurse! But this time she didn't kill me and she said, that went much better! I said, that's because You Listened to Me!

When the nurses had called my house they informed everyone that It was a hairline fracture of the kneecap. But on the third day (the day I was being sent home) the doctor told Nicole, it was the femur bone that was broken and that they were not going to cast or brace my leg. Instead, they would send me home with the pillow splint! I was asked if I had a way home and I replied, the truck was the only vehicle so they had to arrange a ride home and said it has to be on a gurney since the doctors didn't do anything do my broken (femur) leg but put between to stupid pillows with tape! Oh! And both of my feet were also badly stained but they weren't wrapped or anything, either!

A case in point - The Detective never called or came to the hospital to talk to me about the accident! Which, I thought was stupid, wrong and irresponsible of him! But I had heard he was a complete arrogant, ass_____! Not to mention, ignorant, careless, etc!

I spent the next (to date) months in my adjustable bed trying to heal which was very extremely painful and my upper body was nearly covered in extremely deep, deep bruises which lasted 3 to 4 months! I needed help with everything and the bed ban was just as bad, and painful as sleeping! Every day was/is pain, and it took 3 people to help me move, like the bedpan, wash up, etc! And the day after I got home my sister Nicole and Steve kept calling my regular (Dr.Sharma) doctor to get the referrals for having my leg immobilized by a cast, etc! And a referral for Loma Linda's damn orthopedic, it took the office 2 days to call back and when the referrals came through, about a week later. The one for my leg was (companies wrong) it said, need to see an ortho for my leg as I have Cerebral Palsy. It didn't say anything about needing to see him due to an accident and my left femur was broken = enclosed compound fracture! So, the referral had to be rewritten by my doctor and resubmitted to my (IEHP) insurance, it took about four more days or so.

For them to get the referral back to me! Nicole then made my appointment to go see Loma Linda's (Damn) orthopedic and made my transportation arrangements with a medical van as I han to go down on a gurney due to my broken left femur and the fact it was in between 2 stupid pillows!

The ride down there took about an hour an a half to 2 hours. HOWEVER, the appointment was a complete utter nightmare! He said, that if it was his family member, he would absolutely recommend and do the surgery

They have continually (to this day/date) repeatedly refused to give me a copy of them, why, I would love to know why. The only thing we can think of is that they are trying to cover something up.

Anyway, the ortho kept talking to Nicole as though, I wasn't even there, he also kept asking her if I had all my facilities, he did that 4 to & times! Which was pissing off Nicole and Nicole could see I was most Irate, as well! He sent me for new X-rays but when he got them, he finally turned to me, he asked if I understood that I have CP and that I. would have to learn to deal with my ( being 2 centimeters off) leg the way it is, but if I did want surgery I had better do it quickly as my leg is already 25% healed (as he ruffly picked it up, saying, see its stift) as he let go of it! I said, ok let's do the surgery but he went on to say, he refused to do the surgery on me because I have Cerebral Palsy, and that I don't need to walk again! I then asked. for a cast but once again, told me since it should be a long leg cast (i would not be able to keep it clean when using the bedpan) I kept trying to tell him that, I could/would as I have had many long leg casts in my younger days! But all he did was wish me luck as he walked out of the room! Nicole then walked out behind him, requested he at least give me some kind of back and a manual wheelchair for future appointments, he begrudgingly did order them! When then left to go home, I was so IRATE that I began to scream, scream (and I am still Screaming) mostly on the inside but there were also many tears (to this dare) as well!

When we got home (Nicole helped me find other orthopedics) which we got referrals to go see, four in all! And during all this, the damn idiot detective said, I had to email my statement to him as he refused to come talk to me but no detective did, for that matter!

Now, the point of interest - the woman in charge of (at my doctor's office) referrals (who wasn't doing her job, in a timely manner, was replaced by a woman who was getting my referrals (correctly) within hours to 2 days, at most!

Before leaving, we got paper copies of my new X-rays before we left, got home, Nicole called for a referral to see him, that referral took a week or so to get back. When we went down to Arrowhead Regional Hospital in Colton, Ca. It was enormous and it had everything and I mean everything!

Well, while we waited to see this ortho, I kept thinking and even said to Nicole, J should I been brought here instead, had they brought me here, I should not be iin this Hell, she agreed!

We soon saw the ortho a short lime later, he wanted a better look at my leg so he ordered a CT and an NRI both of which I got within a 5 week period due to my doctor's office, see the woman that was doing my referrals quickly was mysteriously fired and replaced! We then made the appointment to see him but was told that he wouldn't be back in the office until the first week in September and here it was the beginning of August! So, I made the appointment for September and kept the appointment that Arrowhead made with the ortho filling in for my ortho, later that month! Well, Nicole and I went to that appointment, I had been using my horrid manual since my leg brace with elevated footrest! When we got there we waited what seems, like forever, after taking mire x-rays! The ortho was a (woman) resident and she said that, my leg is now healed and straight, even though, its 2 centimeters off! No, need to straighten it, just lots of intense therapy but I wanted my leg straightened = back the way it was, before the accident! I said I should not have a deal with/life with a doctor's neglect! It's not right I was pisst-off! As we left, I told Nicole (no lawyer cares enough go wants to help me! I don't matter! She agreed but said, we will find one! You are important and what they did was wrong! And they need to be held accountable! Because all the hospital had to do, immobilize your leg, by a cast or something. We went home and I waited until my appointment with the ortho in September, it helps the one doctor who said that she does the surgery, would keep his word! Oh! When September cans and we went to my appointment, he came in and said, (after looking at the latest x+rays) I'm not going to do the surgery because your leg is now fully healed straight though, its 2 centimeters off! And it will support your weight with (extensive therapy) knee brace and I suggest a hip brace, too!


And as I sat there, I looked at my sister, Nicole, with a look between real angry and I was about to lose it! All this shit was needless, all the hospital had to do was immobilize my left keg by a cast or, something! Or, the f______ Loma Linda ortho doing the surgery or at least, giving me a.cast! Instead of treating me, like a none human being! Not to mention, all the time wasted due to all of the f ______referrals that were written wrong, not submitted correctly, approved within days, as they should've been, etc!

I WAS / AM STILL LIVID - I SHOULD NOT HAVE TO BE MADE TO LIVE WITH THIS WITHOUT HAVING ALL THOSE INVOLVED PAY! ITS NOT RIGHT OR FAIR!

My treatment while in Loma Linda was Neglectful, abusive, discriminating and it made me feel less then human! I know, what they did with my leg was Abuse and it's against the law to abuse the disabled in any way! I have not had a real second's peace since before all this Crap and no one is listening to me that can legally help! And the Loma Linda's Orthopedic denied me my surgery to straighten my left leg because I have Cerebal Palsy! It's wrong!

Bottom line, every day of my life, ever since, the accident is painful, challenging, and makes my Cerebral Palsy so much more impossible!

You poor woman there has to be a lawyer out there to help you. I have a great ortho doctor that I know can help you but he is in Baltimore
You were treated very poorly keep callin lawyers I am sure there is someone that can help you

To begin with - I have been at this for nearly a year, to no avail! And no one will help me in a legal way, which is pissing me off because ever since the (Dodge 1500) truck accident April 2, 2017 all us involved have been having major problems! My long time friend/caregiver (I have Cerebral Palsy) who was driving had broken is collar bone, was extremely bruised for 4 months, neck brace for six months. He still has problems. Oh! He had coverage but it was the bare minimum as it was all he could until he got paid. My nephew Jeremy who is 6 foot and really slim was a sleep in the back seat. He now has black-outs going down hill. As, for me, I got the worst of it, and Loma Linda and doctors who were responsible for my care as well as a few of the nurses treated me with less care, etc, because i have Cerebral Palsy and used a walke4!

Below is part th account in detail of what happen in its entirety! It was written in letter form for letters! However! the letter, is in parts as it’s quite long.


To whom this, ll Concern:

I was in a personal truck accident last April and ever since I've have been trying to find legal justice and I'm always told can't help or won't help you! Which is, unfair as I am a little person who was discriminated against because i have Cerebral Palsy and so i did not receive the proper care for my broken left (enclosed compound fracture) of my left leg! Which was never immobilized just because I have Cerebral Palsy! Yes, I walked with a walker but not good enough for them to correctly treat me! This is what the doctor and orthopedic at Loma Linda told me and my sister Nicole! —

Last April the truck my I was in a roll over, it rolled 4 times, I broke my left leg, it had an enclosed compound femur fracture! However, it was never immobilized in any way! The ortho said you need surgery but he replied (I refuse to do the surgery) as you have Cerebral Palsy and you don't need to have your leg (its 2 centimeters off) straightened, and you should learn to live with it as it is, and you may not walk again, either! So, just deal. I consider that, Denying Me, Discrimination, just because I have Cerebral Palsy! It's Wrong and against the human rights law, so I thought! Besides. Any Ambulatory (non-disabled) person with a broken leg would've had their leg straightened and immobilized in some way! So, why, is the orthopedic who (Refused/Denied Me) the wanted and needed surgery, Allowed to get away with this!? And so far he is... Why?

After seeing 4 other orthopedics who all agreed that had my (enclosed compound femur fracture) been improperly set/immobilized, the night of the accident, my left leg would have healed straight! And my (left) hip would have never had to compensate for the way I sat, do to the pain! Which means, my hip now is not staying in place so I now have to where a hip brace, forever, etc! Which makes my every day life 10,000 times harder as I now need much more help doing and moving - thus making - My Cerebral Palsy so much more difficult to life with! And The other orthopedics wouldn't help because I needed an ortho specialist which the forth orthopedic, referred me to, at Arrowhead Regional Medical Hospital!

Oh! He wanted to do the surgery but he wanted extra tests which took another 6 weeks with getting the referrals for everything so by the time I saw him, my leg had healed, but not straight! He said, he'd would have to rebreak my leg to straighten it and he didn't want to do that as I've been through enough this year, 2017, I spent it in bed. And I am still in bed!

Hey girl I just came across your blog as I'm looking for a Medical Malpractice Attorney myself. I now live in South Dakota, but lived in California for 25 years. Your story just broke my heart. I just came across these attorneys whom do medical malpractice & handle both of our situations in both of our States. Call them Doll & they don't collect unless you win.
